Terms of Service for Blendpixl These Terms of Service (the “Terms”) constitute a legally binding agreement between you (“User” or “You”) and the operator of the Blendpixl mobile application (the “App”) (hereinafter “We”, “Us”, or “Our”). By accessing, downloading, or using the App and its AI-powered services (including text-to-image generation, image stylization, AI face swapping, image redrawing, and AI clothing replacement, collectively the “Services”), You acknowledge that You have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy (incorporated herein by reference). If You do not agree to these Terms, do not access or use the App or Services. 1. Eligibility To use the App and Services, You must: (a) be at least 13 years of age (or the minimum legal age required to use such services in Your jurisdiction); (b) have the legal capacity to enter into a binding agreement; and (c) comply with all applicable laws, regulations, and these Terms. If You are under the age of 18, You must obtain the consent of a parent or legal guardian before using the App, and such parent or legal guardian agrees to be bound by these Terms on Your behalf. 2. User Account (if applicable) 2.1 Account Creation You may be required to create an account to access certain features of the App. When creating an account, You agree to provide accurate, complete, and up-to-date information (including a valid email address, if requested). You are solely responsible for maintaining the confidentiality of Your account credentials (username, password) and for all activities conducted under Your account. You agree to notify Us immediately of any unauthorized use of Your account or any security breach. 2.2 Account Termination You may terminate Your account at any time through the App’s settings. We reserve the right to suspend or terminate Your account, without prior notice, if You violate these Terms, engage in fraudulent or unlawful activity, or if We determine that Your account use poses a risk to the App, Services, or other Users. Upon account termination, You will lose access to all content associated with Your account, and We will delete Your account data in accordance with our Privacy Policy. 3. Use of the App and Services 3.1 Permitted Use You are granted a limited, non-exclusive, non-transferable, revocable license to use the App and Services for personal, non-commercial purposes (unless explicitly authorized by Us in writing for commercial use). This license allows You to: (a) access and use the App’s features as intended; (b) upload content (images, text prompts, etc.) solely to utilize the Services; and (c) download or share content generated through the Services, provided You comply with these Terms and all applicable laws. 3.2 Prohibited Conduct You agree not to use the App or Services for any unlawful, unethical, or harmful purpose. Without limitation, You shall not: - Upload, generate, or distribute content that is illegal, obscene, violent, hateful, discriminatory, defamatory, or infringing on the rights of others (including copyright, trademark, privacy, or Right of Portrait); - Use the Services to create or distribute deepfakes or misleading content that could harm individuals, spread misinformation, or violate public interests; - Upload content that contains the likeness of any person without obtaining their explicit consent (except for Your own likeness); - Attempt to reverse engineer, decompile, hack, or modify the App, its code, or the Services, or bypass any security measures or access controls; - Use bots, scrapers, or automated tools to access or use the App or Services in a way that disrupts or overloads our systems; - Resell, sublicense, or redistribute the Services or any content generated through the App to third parties; - Use the App or Services to violate any applicable laws, regulations, or third-party agreements; - Engage in any activity that could damage, disable, or impair the App, Services, or our infrastructure. 4. Content Ownership and License 4.1 User Content You retain full ownership of all content You upload, submit, or input into the App (including images, text prompts, and personal photos) (“User Content”). By uploading User Content, You grant Us a limited, non-exclusive, revocable license to process such User Content solely to provide the Services to You. This license does not transfer any ownership rights to Us, and We will not use, store, or share Your User Content beyond what is necessary to deliver the Services, as outlined in our Privacy Policy. 4.2 AI-Generated Content You retain ownership of all content generated through the Services using Your User Content (“AI-Generated Content”), provided such content does not infringe on third-party rights. We reserve a non-exclusive, worldwide, royalty-free license to use, display, and promote AI-Generated Content (without identifying You) solely for the purpose of marketing and improving the App and Services, unless You opt out of such use through the App’s settings. 4.3 Critical License Limitation for Facial Content Consistent with our Privacy Policy, We do not store any facial data, facial templates, or biometric identifiers derived from Your User Content. The limited license granted above does not include the right to store, retain, or reuse any facial content beyond the real-time, in-session processing required to deliver the requested Service. All facial data is immediately and permanently deleted after processing is complete. 5. Privacy and Data Protection Your use of the App and Services is subject to our Privacy Policy, which details how We collect, use, store, and protect Your information. By using the App, You consent to the data practices described in the Privacy Policy, including the temporary processing of facial data (with no storage) and the use of non-identifiable data to improve the Services. We will never sell, rent, or share Your personal data or User Content for commercial purposes without Your explicit consent. 6. Service Modifications and Termination We reserve the right to modify, suspend, or terminate the App or any part of the Services at any time, with or without notice, for any reason (including technical issues, legal compliance, or business needs). We shall not be liable to You or any third party for any modification, suspension, or termination of the App or Services. We may also update these Terms from time to time; material changes will be posted in the App with a revised “Last Updated” date, and continued use of the App after the update constitutes Your acceptance of the revised Terms. 7. Disclaimers of Warranty The App and Services are provided on an “as is” and “as available” basis, without any warranties of any kind, express or implied. We do not warrant that the App or Services will be error-free, uninterrupted, secure, or compatible with all devices or software. We do not guarantee the accuracy, quality, or suitability of any AI-Generated Content, and You are solely responsible for reviewing and verifying any content before using or sharing it. All warranties (including implied warranties of merchantability, fitness for a particular purpose, and non-infringement) are disclaimed to the maximum extent permitted by applicable law. 8. Limitation of Liability To the maximum extent permitted by applicable law, We shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with Your use of the App or Services. This includes, but is not limited to, damages for loss of data, loss of profits, or harm to reputation, even if We have been advised of the possibility of such damages. Our total liability to You for any claim arising from these Terms or the use of the App shall not exceed the amount You paid (if any) for the Services in the past 12 months. We shall not be liable for any damages caused by Your violation of these Terms, third-party actions, or circumstances beyond our reasonable control. 9. Indemnification You agree to indemnify, defend, and hold harmless Us, our affiliates, employees, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with: (a) Your use of the App or Services; (b) Your violation of these Terms or applicable laws; (c) Your User Content or AI-Generated Content (including any infringement of third-party rights); (d) Your unauthorized use of the App or Services; or (e) any conduct that harms Us or other Users. 10. These third-party platforms are not controlled by Us, and We are not responsible for their terms of service, privacy policies, or content. Your use of third-party links or services is at Your own risk, and You agree to comply with the terms and conditions of such third parties. 11.
